1. DEFINITIONS AND TERMS
Serplast – is the trade name of S.C. SERPLAST S.R.L, a legal entity of Romanian nationality, with its registered office in Oradea, Str.Emilian Mircea Chitul 12, with order number in the Trade Register J05/4921/1994, unique tax registration code RO6733523.
Seller – Serplast
Buyer – natural person / legal entity or any legal entity that creates an Account on the Site and places an Order.
Client – natural person / legal person who has or obtains access to the CONTENT, through any means of communication made available by Serplast (electronic, telephone, etc.) or based on an existing user agreement between Serplast and it and which requires the creation and using an ACCOUNT.
User – any natural/legal person registered on the Site, who, by completing the Account creation process, has agreed to the site-specific clauses in the General Terms and Conditions section.
Nickname – pseudonym by which a specific User/Client/Buyer can add Content to the Site. The nickname is associated with the information on the Site of the User/Client/Buyer under the name “Username”.
Account – the section of the Site consisting of an e-mail address and a password that allows the Buyer to submit the Order and which contains information about the Client/Buyer and the history of the Buyer on the Site (Orders, tax invoices, Goods guarantees, etc.).
Favorites – section of the Account that allows the Buyer / User to create Lists.
Website – domain www.serplastsrl.ro and its subdomains.
Order – an electronic document that acts as a form of communication between the Seller and the Buyer through which the Buyer conveys to the Seller, through the Site, his intention to purchase Goods and Services from the Site.
Goods and Services – any product or service, including the documents and services mentioned in the Order, to be provided by the Seller to the Buyer as a result of the concluded Contract.
Contract – represents the remote contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.
Content • all the information on the Site that can be visited, viewed or otherwise accessed by using an electronic device;
• the content of any e-mail sent to the Buyers by the Seller by electronic means and/or any other means of communication available;
• any information communicated by any means by an employee/collaborator of the Seller, the Buyer, according to the contact information, specified or not by him;
• information related to the Goods and/or Services and/or the rates applied by the Seller in a certain period;
• information related to the Goods and/or Services and/or rates charged by a third party with whom the Seller has concluded partnership contracts, during a certain period;
• data relating to the Seller, or other privileged data thereof.
Comment – appreciation or observation with a critical purpose, on the side of a Review or other comment.
Question – form of addressing other Users/Clients/Buyers in order to obtain information about the products or services on the respective page.
Answer – written information that is sent to the User/Client/Buyer who asked a Question on the Site, on the page of a specific product. The answer is an explanation offered by a User/Client/Buyer to another User/Client/Buyer in a discussion.
Document – these Terms and Conditions.
Specifications – all specifications and/or descriptions of the Goods and Services as specified in their description.
2. CONTRACTUAL DOCUMENTS
2.1. By registering an Order on the Site, the Buyer agrees to the form of communication (telephone or e-mail) through which the Seller conducts its commercial operations.
2.2. For justified reasons, the Seller reserves the right to change the quantity of Goods and/or Services in the Order. If he changes the quantity of Goods and/or Services in the Order, he will notify the Buyer at the e-mail address or telephone number provided to the Seller when placing the Order.
3. ONLINE SALES POLICY
3.1. Access to place an Order is allowed to any Customer/Buyer. For justified reasons, Serplast reserves the right to restrict the access of the Client/Buyer in order to place an Order and/or to some of the accepted payment methods, if it considers that based on the behavior or activity of the Client/Buyer on the Site, his actions could harm Serplast in any way. In any of these cases, the Client/Buyer can contact Serplast’s Customer Relations Department, to be informed about the reasons that led to the application of the aforementioned measures.
3.2. Communication with the Seller can be done through direct interaction with him or through the addresses mentioned in the “contact” section of the Site. The seller has the freedom to manage the information received without having to provide justifications for this.
3.3. Serplast can publish on the Site information about Goods and/or Services and/or promotions practiced by it, within a certain period of time and within the limit of available stock.
3.4. All prices related to the Goods and/or Services presented on the Site are expressed in RON (RON) and do not include VAT. The currency and payment method can be changed to Forint, Euro and Dollar.
4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
4.1. The content, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site, are the exclusive property of Serplast, which is All rights obtained in this regard directly or indirectly (through licenses for use and/or publication) are reserved.
4.2. The Customer/Buyer is not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any Content in any context other than that originally intended by Serplast, include any Content in outside the Site, removing the signs that signify the copyright of Serplast on the Content, as well as participating in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the Content.
5. COMMAND
5.1. The Client/Buyer can place Orders on the Site, by adding the desired Goods to the shopping cart, and then complete the Order by making payment through one of the expressly indicated methods. Once added to the shopping cart, a Good is available for purchase as long as there is stock available for it. Adding a Good/Service to the shopping cart, without completing the Order, does not result in the registration of an order, implicitly neither does the automatic reservation of the Good/Service.
5.2. By completing the Order, the Buyer agrees that all the data provided by him, necessary for the purchase process, are correct, complete and true on the date of placing the Order.
5.3. By completing the Order, the Buyer agrees that the Seller can contact him, by any means available / agreed by the Seller, in any situation where it is necessary to contact the Buyer.
6. BILLING – PAYMENT
6.1. The prices of the Goods and Services displayed on the website www.serplastsrl.ro do not include VAT. .
6.2. The price, payment method and payment term are specified in each Order. The Seller will issue an invoice to the Buyer for the Goods and Services delivered, the Buyer’s obligation being to provide all the information necessary to issue the invoice in accordance with the legislation in force.
6.3. The Seller will send the Buyer the invoice related to the Order containing Goods and/or Services sold by Serplast.
6.4. For a correct communication of the invoice related to the Order, the Buyer has the obligation to update his Account data as often as necessary and to access the information and documents related to each Order, existing in the Account.
7. DELIVERY OF GOODS
7.1. The Seller undertakes to deliver the Goods in a door-to-door courier system to the Buyer or to Serplast headquarters, according to the Customer’s option.
7.2. The seller will ensure the proper packaging of the Goods and will ensure the transmission of the accompanying documents.
7.3. The customer undertakes to be present at the indicated delivery address, and to pick up the order, otherwise he will bear the transport fee related to a possible new delivery.
8. TRANSFER OWNERSHIP OF GOODS
8.1 Ownership of the Goods will be transferred upon delivery, after payment has been made by the Buyer at the location indicated in the Order.
9. LIABILITY
9.1 The Seller cannot be responsible for damages of any kind that the Buyer or any third party may suffer as a result of the Seller fulfilling any of its obligations under the Order and for damages resulting from the use of the Goods and Services after delivery and in particular for their loss.
10. PERSONAL DATA PROCESSING
10.1 By completing any registration forms on the website www.serplastsrl.ro, participants agree that their personal data entered in the form will be processed by Sc.Serplast S.R.L. for the declared purposes of this site as well as for statistical purposes, according to the regulations provided for in Law no. 677/2001, as subsequently amended by the GDPR, according to European norms.
10.2 All participants are guaranteed their rights in accordance with law 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, a law that provides the data subjects with the right to information, the right to access data, the right to intervene on the data and the right of opposition. Each participant has the right to request exclusion from the association’s database by sending an email to office@serplastsrl.ro
10.3 At the express request by email of the participants, Sc. Serplast S.R.L. undertakes: to update, block, delete or transform into anonymous data, free of charge, the data whose processing is not in accordance with the provisions of Law no. 677/2001 and GDPR regarding the protection of individuals regarding the processing of personal data and the free movement of such data; to stop, free of charge, the processing of the applicant’s personal data.
10.4 For the erroneous registration of personal data, S.C. Serplast S.R.L. assumes no responsibility.
11. TERMS AND CONDITIONS
11.1 The terms and conditions of use can be changed at any time by updating this website, these changes becoming mandatory and with immediate effect for all users/customers.
12. MARKETING / PICTURES
12.1. The pictures and videos of the products presented in this virtual store and/or in the web pages and subpages linked to it are indicative, they may differ from the real ones of those products and they may also show accessories that are not included in the package of the product sold. All photos presented may not reflect the updated images and features of the products. The product packaging may differ in reality from the photos or videos shown on this website. The design, colors, shapes, weights, dimensions may differ in reality from those presented on the website. The technical specifications and characteristics described are indicative, can be changed without prior notice and do not constitute a contractual obligation between the supplier and the buyer.All presentations do not bind the manufacturing company or the supplier to the customer. Before purchasing a product presented on this site or on one of the web pages related to it, you must ask for updated and accurate information about the desired product, using only for information what is described and presented (through pictures, videos and text) in the site or in the web pages linked to it.
13. RETURN POLICY
13.1. According to the provisions of OUG 34/2014 regarding consumer protection when concluding and executing distance contracts: “The consumer has the right to notify the merchant in writing that he is renouncing the purchase, without penalties and without citing a reason, within 14 days of receiving the product or, in the case of services, from the conclusion of the contract” If you want to return the purchased products, S.C. Serplast S.R.L. guarantees you the return term stipulated by law, namely 14 days from receiving the product.

Notify the Customer Service department in writing at the address comenzi@serplastsrl.ro, regarding the package you are going to return
Send the return order together with the included Return Form to the address: 12 Sfantul Apostol Andrei str.
Within a maximum of 14 calendar days from the receipt of the return, you will be notified via e-mail regarding the status of the refund of the value of the returned product(s), to the account specified in the Return Form
The direct costs of returning the products are borne by the buyer. It is necessary that the original product be sent to us by a courier organized by you (other than the Romanian Post)
If you received a product with a defect or other than the one ordered, please send the request in writing to comenzi@serplastsrl.ro, together with the photos of the received products. The return in this case will be organized by S.C. Serplast S.R.L.
Return parcels sent without a Return Form included may cause delays in the processing of refunds.
14. MAJOR FORCE
14.1. None of the parties will be responsible for non-execution of its contractual obligations, if such non-execution on time and/or in an appropriate manner, in whole or in part, is due to a force majeure event. Force majeure is the unforeseeable event, beyond the control of the parties and which cannot be avoided.
14.2. If, within 15 (fifteen) days from the date of its occurrence, the said event does not cease, each party will have the right to notify the other party of the full termination of the Contract without any of them being able to claim other damages to the other.
15. APPLICABLE LAW – JURISDICTION
15.1 This Agreement is subject to Romanian law. Any disputes arising between Serplast and Customers / Buyers will be resolved amicably or, if this is not possible, the disputes will be resolved by the competent Romanian courts in the Municipality of Oradea.
